A middle aged plumber named "Mario Lopez" recently filed a lawsuit against Nintendo for using his image without consent. Mario Lopez filed a trademark for the cartoon character that he uses to promote his business, "Mario's faucet fixers" in 1978.
Mr. Lopez is seeking damages to the tune of 1% of the revenue of every Mario game ever sold. Citing a previous ruling against Nintendo, forcing them to pay 1.82% of each 3DS sold to Tomita Technologies, Mr. Lopez believes this measly 1% is a bargain.
